DATA PROTECTION INFORMATION CLAUSE
Ensuring the privacy of our users is a priority for us. It concerns personal data and data stored in cookies and derivative technologies that we collect when you book a tourist event or use websites belonging to ADV Ltd.
To find out on what terms the entrusted data will be processed, read the information clause below.
The solutions we use are in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), the so-called GDPR.
CONTROLLER OF PERSONAL DATA
The controller of the personal data provided by you at the stage of searching for a tourist event is ADV Sp. Z o.o. with its seat in Katowice, 40-019 Zygmunta Krasińskiego Street 29/9 In connection with the conclusion and performance of the contract for participation in a tourist event, the controller of the personal data provided by you will be the tour operator with whom you conclude the contract. In connection with the conclusion and implementation of a contract for travel insurance, the controller of the personal data provided by you will be the Insurer with whom you conclude the contract. ADV Ltd. will then be the processor of the personal data provided by you on behalf of the tour operator and on behalf of the Insurer. Notwithstanding the above, ADV Sp. Z o.o. shall be the controller of the necessary personal data provided by you in order to promote the services offered as part of the legitimate interest of the controller.
RESPONSIBLE PERSON
The person who takes care of personal data in our company is the Data Protection Officer. In all matters related to the processing of personal data, you can contact him by email: kontakt@advpoland.pl. He will answer your questions as soon as possible, within a maximum of 30 days.
PURPOSE AND LEGAL BASIS OF DATA PROCESSING
We will process the personal data you provide:
a) in order to enable the conclusion and subsequent execution of: the contract for participation in a tourist event with the tour operator and the travel insurance contract with the Insurer, as well as within the framework of the legitimate interest of the data controller in order to provide around-the-clock care and contact in matters related to the tourist event booked through us - on the basis of Article 6(1)(b) and (f) of the General Data Protection Regulation of April 27, 2016. (hereinafter: "GDPR"),
b) to promote the services we offer and learn about your preferences, under the legitimate interest of the data controller. This will allow us to tailor the services and content provided to you to your expectations. High quality is our priority, which is why we may direct short surveys or requests for feedback to you after a particular service has been provided, so that you can let us know what else we can do better. We assure you that we will send surveys and requests for opinions with such frequency and in such a way that they do not violate your right to privacy - based on Article 6(1)(b) and (f) of the GDPR Regulation,
c) for the purpose of bookkeeping and settlement of travel and travel insurance contracts concluded through us, as well as other contracts concluded with us - based on Article 6(1)(c) of the GDPR Regulation,
d) as part of the controller's legitimate interest in defending our rights and asserting claims under our business activities, which may involve the need to process personal data for this purpose - based on Article 6(1)(b) and (f) of the GDPR Regulation.
RECIPIENTS OF DATA
Due to the need to ensure proper organization, e.g. in terms of technical and IT infrastructure or in the day-to-day affairs of our business, the following recipients of your personal data may have access to the personal data you have provided:
a) Our authorized employees.
b) Service providers who have been contractually entrusted with the processing of Personal Data for the performance of services provided by and for us. In particular, these are entities (and their authorized employees) providing IT and technical services. These entities act on our behalf to the extent necessary for the proper performance of the services entrusted to them.
c) Entities entitled to receive Personal Data under the provisions of law.
d) Service providers supplying us with technical, organizational and management solutions for our company (in particular, courier and postal companies).
e) Providers of legal and advisory services and those supporting us in the assertion of due claims and defense of our rights (in particular, law firms, tax firms, debt collection companies).
f) Tour operators, insurance companies and banking institutions with whom we have concluded agency agreements, agreements for the intermediation in the sale of products and/or the provision of services, to the extent necessary for the proper performance of the agreements between us or agreements concluded through us.
DATA RETENTION PERIOD
The length of time we will keep your data depends on the purpose for which we process them:
a) In the case of data processing for the purpose referred to in Section 3(a) and (d) (for the conclusion and performance of the travel event contract and the defense of our rights and the assertion of claims arising from our business activities), we may store the personal data you have provided to the extent necessary for the assertion of claims and the defense of our rights. The storage period is based on the law, in particular the Civil Code.
b) In the case of data processing for the purpose referred to in Section 3(b) (to promote the services we offer and learn about your preferences), we will process the personal data you provide for as long as you use our services. At any time you can quickly and easily i.e. "unsubscribe" links included in the messages sent to you (e.g. Newsletter ) notify us that you do not want to receive such content from us. We will then stop sending them in accordance with your request.
c) In the case of data processing for the purpose referred to in point 3 c (for tax and accounting purposes), we may keep the data you provide to the extent and for the period required by law - 5 years counting from the beginning of the year following the financial year to which the data refers, and after the completion of the services to the extent and for the period necessary to settle the contract.
After the expiration of the above-mentioned periods, the personal data provided by you are deleted.
MANAGEMENT
At any time you have the right to request from us: access to your personal data, rectification, erasure, restriction of processing, to object to its processing under the legitimate interest of the controller (Article 6(1)(f) of the GDPR) or for statistical purposes (Article 89(1) of the GDPR) for reasons related to your particular situation, as well as to processing for direct marketing purposes, and the right to data portability. As a person submitting a request or task regarding the processing of your personal data, you may be asked by us to answer a number of questions related to your personal data that will enable us to verify your identity.
RIGHTS
You have the right to file a complaint with the PUODO (President of the Office for Personal Data Protection) if you believe and can justify that we are processing your personal data in violation of the General Data Protection Regulation of April 27, 2016 (GDPR).
OPTIONALITY OF DATA
We do not oblige you to provide us with your personal data. You provide it voluntarily, but remember that it is necessary in order for us to be able to mediate the conclusion by you of a contract for participation in a tourist event with a tour operator or a travel insurance contract with an Insurer and, if you wish, to send you our: e.g. Newsletter or other services provided by us electronically, as well as to contact you by phone.
PROCESSING
Your data will be processed by us by automated means, including profiling, but binding decisions will not be automated. Nor will it have any legal effect on you or similarly materially affect you. This means that the information you receive from us, e.g. in the Newsletter or the content we show you on our website and in the ads we display, may be linked to how you used www.advpoland.pl (for example, the tours you viewed or the preferences you selected in the search engine). This allows us to better tailor the content of our electronically delivered services to your preferences, needs and interests. For more details on profiling, see Privacy Policy.
TRANSFER OF DATA TO COUNTRIES OUTSIDE THE EUROPEAN ECONOMIC AREA
Your personal data may be transferred outside the European Economic Area to recipients of your data based on appropriate legal safeguards, which are standard contractual clauses for the protection of personal data approved by the European Commission. For transfers from Europe to the US, certain entities located there may additionally provide an adequate degree of data protection under the so-called Privacy Shield program (see https://www.privacyshield.gov/ for more information). Newsletter
Newsletter allows you to subscribe to a free email with offers, promotions and news. Subscription takes place in two stages. The first is the registration of the email on the website, and the second is the activation, by clicking on the link that is sent to the provided email address. At any time you can opt out of receiving emails with offers by clicking on the link included in each newsletter sent.
PDF directory
Allows you to download a document containing general information about the selected destination. It does not constitute an offer within the meaning of the Civil Code. It contains the most important information about the proposed trips to the selected destination.
Download of the PDF document is connected with indication of data for establishing marketing contact.
Personal data
All users of the ADV Sp. z o.o. website remain anonymous, and it will depend only on the user's decision when he registers or logs in to the website.The data entered by you into the reservation form will be processed by ADV Sp. z o.o. in accordance with the Act on Personal Data Protection of August 29, 1997 (consolidated text Journal of Laws No. 101 item 926 of 2002, as amended). The personal data provided to us will be processed for the purpose of executing the agreement and, if you give us your consent, for marketing purposes involving the promotion of our services by telephone and e-mail and post.
Online reservations
Wherever we talk about online reservations, you get the opportunity to book an event immediately. This means that a given offer (flight, hotel room, food, transportation, insurance) on a specific date has been blocked for you.After payment is made, it is confirmed. Wherever it is not possible to automatically block places for you, confirmation of the reservation by our consultants follows.
Data transmission - SSL
Through the use of an SSL certificate, your reservation data are secured during their transmission over the Internet. SSL encrypts and scrambles the transmitted messages and authenticates the servers through which they are transmitted. SSL certificates are issued by authorization companies that verify the reliability of the service.
